Residential Leases

Rodgers & Burton have considerable experience in the preparation of both short and long Residential Leases. We believe in tailoring Leases to particular properties and situations rather than simply taking an "off the shelf" precedent. This avoids the pitfalls that arise from inappropriate clauses and the failure to include proper provisions (for example) for recovery of Landlord's costs.

This is particularly important in modern short Leases where the costs recovering of arrears or dealing with breaches of covenant short of forfeiture are often not provided for. The same is the case with property abandoned at the end of a tenancy when Landlords sometimes find themselves faced with tenants goods with no mechanism to lawfully dispose of them.

With wide experience of dealing with long Leases we are able to draft new long Leases, for example on acquisition of a freehold again avoiding the pitfalls of many of the "off the shelf" leases. Again we will provide for proper recovery of Landlord’s costs and ensure that the lease contains a workable service charge clause.

We also have considerable experience in the approval of leases when acting for lessees.  It is important that lessees take specialist advice prior to entering into a new or extended lease to ensure that the lessee is adequately protected in terms of the maintenance and insurance of the building and that all other necessary obligations and rights are properly provided for.  This is important not only for the proper maintenance and management of the building but also to ensure that lessees do not meet difficulties on the resale of their flats due to flaws or ommissions in their lease.

We are less than 10 minutes’ walk from Mortlake main line station.  Coming out of the station follow Sheen Lane up on the same side as the platform for trains going into Waterloo.  Vineyard Path is about 100 m on the right hand side.

If you are coming by car there is free parking in the area around the office after 11.00 am.

You may take a 209 bus from Hammersmith to Avondale Road.  There is a 200 m walk along Mortlake High Street and the offices are behind the Sorting Office.
